Overview
This page, along with the documents it references, outlines the terms of use for accessing and using our website, GIMME - Delivering Local, as a registered user. By visiting or using our website or engaging in our services, you confirm that you accept these terms of use and agree to follow them. When you access our website and/or make a purchase from us, you participate in our Service and agree to be bound by the following terms and conditions (Terms of Service or Terms), including any additional terms and policies referenced herein or accessible via hyperlink. These Terms of Service apply to all users of the website, including but not limited to browsers, vendors, customers, merchants, and content contributors. Please read these Terms of Service carefully before accessing or using our website. By doing so, you agree to be bound by these Terms. If you do not agree with any part of these terms, you are advised not to use the website or its services.
1. Information About Us
GIMME - Delivering Local Mobile Application is operated by Bread Private Limited (NZBN – 9429046164810). Bread Private Ltd is incorporated and registered in New Zealand. GIMME is an alco-bev delivery service through a network of independent alco-bev stores in New Zealand (Partner Stores).
2. Accessing Our Service or Our Services
Access to our website and services is provided on a temporary basis, and we reserve the right to modify or withdraw access without prior notice. We are not liable if, for any reason, our website or services are unavailable at any time or for any duration. Periodically, we may limit access to certain parts of our website or services to registered users only. You are responsible for maintaining the confidentiality of your account login details and for all activities conducted under your account. If you have any concerns about your login credentials or believe they may have been misused, please contact us promptly at hello@gimmedelivery.co.nz.
3. Service
The customer places an order through the GIMME platform, which operates as an online marketplace and delivery service. GIMME provides customers with ordering, payment processing, customer support, and delivery facilitation services.
For orders that include alcohol, the alcoholic products are sold by the relevant Partner Store, which holds a current off-licence under the Sale and Supply of Alcohol Act 2012. The Partner Store is responsible for the retail sale of alcohol and compliance with all applicable alcohol licensing laws.
GIMME facilitates the ordering process, collects payment on behalf of the Partner Store as its agent, and arranges delivery to the customer. While GIMME is the primary point of contact for the customer experience and service delivery, the legal contract for the sale and supply of alcohol is between the customer and the Partner Store.
4. Orders, Availability & Delivery
When you place an order through the GIMME website or Mobile Application, your order is submitted via the GIMME platform to the relevant Partner Store for review and acceptance.
An order is confirmed only once it has been accepted by the Partner Store. For orders that include alcohol, the Partner Store’s acceptance constitutes acceptance of the sale under its off-licence.
GIMME may notify you of order acceptance, facilitate payment processing, and coordinate delivery on behalf of the Partner Store. Confirmation messages or notifications issued by GIMME do not alter the legal relationship governing the sale of alcohol, which is formed between you and the Partner Store.
. All items are subject to availability, so please ensure that you provide a valid email address and phone number, as these are our primary means of communication regarding your order.
It’s important to enter the correct delivery address to ensure successful delivery, as our website and phone will be the main sources of communication with you at the time of delivery. If GIMME creates a web portal in the future, we will update these terms accordingly. Currently, you can also place orders directly through our website powered by Shopify.
If you do not respond to the door at the designated delivery address or fail to answer a phone call within five minutes of our delivery drivers arriving, the driver may return the order back to the store, and you may be charged for the delivery fee. Please note that alcohol orders cannot be left unattended, as age and intoxication verification are required. If an alcohol order cannot be delivered for any reason, your GIMME driver will return it to the partnered store. You will be refunded for the alcohol purchased, but the delivery fee will not be refunded, and a return fee will be applied.
GIMME strives to provide the most efficient delivery service possible. We encourage you to review your order carefully or ask us about any allergies before placing your order. We will do our best to deliver your order within the estimated delivery time provided at the time of ordering. However, factors such as traffic, weather, and other incidents beyond our control may affect delivery times. If a delay occurs, we will make every effort to contact you to inform you of the situation. The estimated delivery time is calculated based on order preparation time and the distance to your delivery address.
5. Location Uses and Permissions
GIMME is a full-service beverage delivery app, and your current location is essential for fulfilling orders. We utilize Geo Location Services to track and display the location of our delivery partners. GIMME does not share location data and adheres to all guidelines and best practices of the iOS and Google/Android stores. While users may deny the use of their location, please note that the GIMME app may not function as intended without Location Services enabled, which is necessary for delivery and fulfillment.
6. Refund Policy
you are not satisfied with the services provided by GIMME, including delivery or platform services, please contact us at support@gimmedelivery.co.nz.
Where the Consumer Guarantees Act 1993 or other applicable consumer protection laws apply, GIMME will provide refunds, remedies, or other resolutions in accordance with those laws. Nothing in this Refund Policy is intended to limit or exclude any rights you may have under those laws.
In circumstances where a refund or credit is not required by law, any refunds, credits, or goodwill gestures are offered at GIMME’s discretion and will be assessed on a case-by-case basis, taking into account the nature of the issue, order details, delivery circumstances, and relevant information from the Partner Store.
Returns and Condition of Products:
Refunds for products returned under special or discretionary circumstances will only be considered where the products are returned in the same condition in which they were supplied, including being unopened, unused, and in their original packaging, unless otherwise required by law.
Delivery Fees:
Unless required by applicable law, delivery fees are non-refundable. This includes situations where an order cannot be completed due to customer unavailability, failure to provide valid identification, refusal of delivery, or other circumstances outside GIMME’s control.
Approved refunds will be processed using the original payment method and may take up to 5–8 business days to appear in your account.
7. Sale of Alcohol
Updated Alcohol Delivery Policy
GIMME is a marketplace and delivery service for liquor stores in Auckland, Hamilton, Dunedin & Christchurch. Their off-license(s) are as follows: Liquor Centre Constellation Drive (007/OFF/47/2024 Exp :10-05-2026), Thirsty Liquor Manurewa (007/OFF/3076/2018), Liquor Library (007/OFF/9202/2021, Exp : 01-08-2027), Fine Wines Dunedin (069/OFF/09/2023 ), Bottle O Botany (007/OFF/3106/2025, Exp 13th May 2026) City Liquor (007/OFF/9077/2021, Exp : 11.06.2027), Thirsty Liquor, Hillcrest (15/OFF/230/2022, Exp - 23-09-2025), Milwater Fine Wine and Spirits, (007/OFF/132/2024 Exp : 21.05.2028), Bottle O Panmure (007/OFF/9130/2021).
GIMME accepts alcohol delivery orders between the hours of 11.00am and 9:00 pm and does not deliver alcohol on Good Friday, Easter Sunday, Christmas Day, and Anzac Day before 1.00pm. Copies of licenses are attached below. 





Auckland Local Alcohol Policy (LAP) Compliance
For deliveries within the Auckland region, alcohol sales made through the GIMME platform are subject to the Auckland Council Local Alcohol Policy and the Sale and Supply of Alcohol Act 2012.
Orders for alcohol from Partner Stores located in Auckland must be placed and accepted no later than 9:00 pm, in accordance with the applicable off-licence trading hours under the Auckland Local Alcohol Policy.
Alcohol deliveries within Auckland will not occur after 11:00 pm or before 6:00 am the following day, in line with national remote sales requirements.
GIMME’s platform is configured to restrict the placement and acceptance of alcohol orders in Auckland outside these permitted hours.
These restrictions apply regardless of estimated delivery time, promotional offers, or order processing delays.
GIMME will not sell alcohol to anyone who is under the age of 18; it is also illegal to buy alcohol if you're under the age of 18, and under the Sale and Supply of Alcohol Act 2012, it is an offense liable on conviction to a fine of up to $2,000. GIMME takes delivering alcohol seriously and complies with the Sale and Supply of Alcohol Act 2012 and is required to comply with the law. Only persons aged 18 years and older are able to order alcohol from GIMME, and we will require age verification upon delivery of your order. Only valid government-issued photo ID will be accepted: any current passport, a current New Zealand driver license, a Hospitality NZ 18+ Card, or a Kiwi Access Card.
Alcohol orders must be received by you in person and will not be left unattended for any reason, and identification must be verified at the point of delivery. GIMME reserves the right to refuse delivery for any reason, including, but not limited to, the recipient is not present, if they don't have a valid ID, if they are under 18, if they are believed to be intoxicated (at our discretion), or we believe (at our discretion) the alcohol is intended for a minor.
If the alcohol cannot be delivered for any reason, your GIMME Driver will return the alcohol to the partnered store. You will be refunded for the alcohol purchased, the delivery fee charged at the time of purchase will not be refunded, and you will be charged a return fee. By placing an alcohol order with GIMME and agreeing to the Terms & Conditions, you're confirming that you (the purchaser) and the receiver are aged 18 years or older and legally allowed to purchase alcohol in New Zealand.
You are responsible for observing local laws around where you can consume or possess alcohol. We encourage the consumption of alcohol to be in moderation and within a safe and responsible environment.
8. Cancellation
You may cancel an order without charge at any time before your order has been accepted. If you wish to cancel an order, please click “CANCEL ORDER” on the orders page on the website, and GIMME will refund you the money. If cancellation is made before your order is accepted, we will refund your payment including delivery charge using the same payment method as you used to originally pay for the order. Please note refunds may take 5 business days from the date of refund to show in your account.
You can cancel an order after it has been accepted by contacting us directly on +64 9 8879417 or emailing us at hello@gimmedelivery.co.nz, citing order number and your name, as well as the items that you wish to cancel, and we will examine the circumstances to process the request. GIMME reserves the right to decline or approve the request. GIMME and the Partner Store may notify you that an order has been cancelled at any time. You will not be charged for any orders cancelled by us, and we will reimburse you for any payment already made using the same method you used to pay for your order.
9. Prices, Payment
Prices include GST and are subject to change at any time at the discretion of GIMME. Please note that prices on our Mobile Application and website may differ from each other. However, no price changes will affect orders once they have been confirmed. The total price of your order will be clearly displayed on the checkout page of our website and Mobile Application, including the prices of items, delivery, and any applicable service fees and taxes.
Payment for all items and deliveries can be made through our website or Mobile Application using a credit or debit card, or other services integrated through our third-party processor, Stripe. Once you confirm your order at checkout, your credit or debit card will be authorized, and the total amount will be marked for payment. You can also use GIMME vouchers or account credit to make your payment, subject to the terms associated with GIMME vouchers and account credits.
You acknowledge that: (i) the prices displayed for menu items or other services through GIMME Delivery may differ from the prices published or offered by Merchants or on third-party websites for the same items. These prices may not reflect the lowest available rates and are subject to change at any time without notice; (ii) GIMME Delivery is not required to disclose its costs, profits, or margins when listing these prices; and (iii) prices may change at any time, at the discretion of either GIMME Delivery or the Merchant (depending on which party sets the price). For some transactions, the subtotal shown at checkout may be an estimate and may differ from the final in-store total, which could be higher or lower. In such cases, GIMME Delivery reserves the right to temporarily place a hold on your payment method for an amount greater than the checkout subtotal, with the final charge applied once the transaction is completed. You are responsible for any applicable transaction taxes (excluding taxes on GIMME Delivery’s income), including sales tax, goods and services tax, and other similar taxes on the services provided under this agreement (including any fees related to subscriptions). If such taxes apply, GIMME Delivery reserves the right to charge you additional amounts to cover the taxes. For all orders in New Zealand, the amounts displayed (including prices, fees, and charges) are inclusive of any applicable goods and services tax, unless otherwise specified, and such taxes will be due along with any other charges under these terms. If the amount charged to your payment method differs from the total amount displayed at checkout, including subtotals, fees, and gratuities, GIMME Delivery reserves the right to adjust the charge accordingly to reflect the correct total. All payments will be processed by GIMME Delivery or its payment processor, using the payment method you have provided. If your payment details change, you or your card provider may provide us with updated payment details. We may use these updated details to prevent any disruption to your services. This includes our right to charge any payment method on file if your initial payment method fails. It is your responsibility to ensure your billing information remains accurate and up to date.
10. Offers & Promotions
Special offers are available from time to time through our Mobile Application. These promotions are at the discretion of GIMME. Unless the promotion terms state a fixed or minimum period for which an offer will be available, it can be withdrawn at any time, unless you have already placed an order based on the offer and we have confirmed the order. These include the loyalty points that you see in your wallet.
11. Delivery
GIMME aims to provide the most efficient delivery service possible. We will do our best to ensure that your order is delivered by the estimated delivery time given to you at the time of ordering. On occasions, factors such as traffic, weather, and incidents out of our control may prevent us from achieving our estimated delivery time. When a delay with delivery occurs, we will do our best to make contact with you to communicate the delay. The estimated delivery time of your order is calculated based on preparation time and distance to your delivery address.
12. Our Liability
To the fullest extent permitted by law, GIMME provides its platform and delivery services on an “as is” and “as available” basis.
Nothing in these Terms is intended to limit or exclude any rights or remedies you may have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other applicable New Zealand law.
To the extent permitted by law, GIMME will not be liable for any indirect, incidental, special, or consequential loss or damage, including loss of profit, loss of opportunity, or loss of data, arising from your use of the GIMME platform or services.
Where GIMME is found to be liable for any loss or damage arising from the provision of its services (including delivery or platform services), GIMME’s liability will be limited to the amount paid by you for the relevant service giving rise to the claim, except where liability cannot be limited or excluded by law.
GIMME is not responsible for the quality, safety, or suitability of alcohol products sold by Partner Stores, which remain the responsibility of the relevant Partner Store under its off-licence and applicable law.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under New Zealand law.
13. Events Outside Our Control
No party shall be liable to the other for any delay or non-performance of its obligations under this Agreement arising from any cause beyond its control including, without limitation, any of the following: act of God, governmental act, war, fire, flood, pandemic, explosion, or civil commotion. For the avoidance of doubt, nothing in clause 11 shall excuse the Customer from any payment obligations under this Agreement.
14. Waiver
Neither you, GIMME, nor the Partner Store shall be responsible to the others for any delay or non-performance of its obligations under this agreement arising from any cause beyond its control including, without limitation, any of the following: act of God, governmental act, war, fire, flood, explosion, or civil commotion.
15. Severability
If any provision of this agreement is judged to be illegal or unenforceable, the continuation in full force and effect of the remainder of the provisions shall not be prejudiced.
16. Entire Agreement
These terms contain the whole agreement between the parties relating to its subject matter and supersede all prior agreements, arrangements, and understandings between the parties relating to that subject matter.
17. Our Right to Vary These Terms and Conditions
GIMME may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are binding on you.
18. Law and Jurisdiction
The New Zealand courts will have jurisdiction over any claim arising from or related to any use of our Services. These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with New Zealand law.
19. Terms and Conditions for Magic Pass Membership
These terms and conditions for GIMME MAGIC PASS govern your purchase and use of a Magic Pass, which is a subscription that renews automatically (the Program or Magic Pass) offered by BREAD PRIVATE LTD (GIMME or we). Participation in the Program is subject to these terms and conditions for Magic Pass. GIMME is a technology platform/company which provides mobile applications for users to arrange and schedule transportation and/or delivery services with GIMME Delivery Partners under agreement with GIMME or certain of GIMME's affiliates. GIMME MAGIC PASS Memberships are provided in connection with use of the GIMME App.
20. How GIMME Magic Pass Membership Works
You may receive an offer in-app or by email for specific renewable benefits, free delivery, and discounts that can be applied on GIMME App purchases (Offer). Each Offer will include important details and terms, such as where and when a Magic Pass may be used, the benefit(s) conferred by the Magic Pass (Magic Pass Benefits), the cost of the Magic Pass (Membership Fee), and the billing interval (Billing Cycle). Please refer to your Offer for details before purchasing the Magic Pass. When you buy a Magic Pass, you agree to have your credit card charged every Billing Cycle on a recurring basis, you agree to these Magic Pass Terms, as well as the specific terms of the Offer. Offers are limited and subject to change.
By participating in this Program, you are agreeing to these Magic Pass Terms. If you do not agree to these Magic Pass Terms, do not participate in the Program.
21. Membership Billing Cycle / Membership Fee Terms
When you buy a Magic Pass, you'll be charged the Membership Fee for your first Billing Cycle on the date of purchase, which activates the Magic Pass for the term set forth in your Offer. Unless you cancel, you'll be charged at the Billing Cycle stated in your Magic Pass Offer based on the initial purchase date on your selected payment method. BY DEFAULT (AND WITH PRIOR NOTICE TO THE EXTENT REQUIRED BY APPLICABLE LAW), YOUR MAGIC PASS WILL AUTOMATICALLY RENEW AT THE BEGINNING OF EACH BILLING CYCLE, AND THE MEMBERSHIP FEE WILL BE AUTOMATICALLY CHARGED TO YOUR SELECTED PAYMENT METHOD. If you do not want your Magic Pass to automatically renew, you can cancel your subscription.
If your selected payment method is declined, GIMME will prompt you for a new payment method but reserves the right to terminate any unpaid periods in your Magic Pass with no further charges to you. GIMME will also automatically retry failed payments periodically over the course of your billing cycle to help you get back to enjoying the benefits of your membership. GIMME and/or its parent, subsidiaries, and/or affiliates are not responsible for any fees charged by the cardholder's bank including, but not limited to, overdraft fees, insufficient funds fees, interest charges, foreign exchange fees, cross border fees, and other penalties levied by the cardholder's bank.
22. Cancel Your Magic Pass
You may cancel your Magic Pass within the applicable GIMME App up to 48 hours prior to your next scheduled payment to avoid further charges. If you cancel your Magic Pass, you will still have access to your Magic Pass Benefits until the end of the current Billing Cycle. All payments are non-refundable and non-transferable, and will not be refunded for any cancellation initiated during a Billing Cycle.
23. Changes to GIMME Magic Pass
GIMME reserves the right to modify or stop offering GIMME MAGIC PASS or change Membership Fees, Magic Pass Benefits, or route prices, at any time in its sole discretion. In the event GIMME increases the Membership Fee of a Magic Pass, we will provide you with thirty (30) days prior notice via email before such changes take effect. All changes will be effective upon your next Billing Cycle, but if you do not agree with the price change, you have the right to reject the new Membership Fee and may avoid these charges by cancelling your Magic Pass.
GIMME may terminate your Magic Pass at our discretion without notice. If that happens, GIMME will give you a pro-rated refund based on charges already applied to your current billing period. We will not give any refund for termination related to conduct that we determine, in our sole discretion, violates these Magic Pass Terms, any applicable law, or involves fraud or misuse of the Magic Pass.
24. Changes to Magic Pass Terms
GIMME reserves the right to modify these Magic Pass Terms. If we make material changes to the Magic Pass Terms while you have an active Magic Pass, we will notify you either in the Magic Pass section of the applicable GIMME App and/or via email. Revised Magic Pass Terms become effective at the beginning of the next Billing Cycle, and your continued use of a Magic Pass constitutes your acceptance of the revised Magic Pass Terms. If you are not willing to agree to the revisions, you may cancel your Magic Pass.
25. Transfer of Rights
GIMME's rights and obligations under the Program may be assigned or transferred by GIMME to any other related or unrelated entity at any time, and performances shall be the responsibility of that entity.
26. Interpretation of Magic Pass Terms
All interpretations of these Magic Pass Terms will be at GIMME's sole discretion, and GIMME's decisions will be final.
27. Disclaimer
The Program and/or any of its features may be unavailable, inaccurate, or interrupted from time to time for a variety of reasons. We are not responsible for any unavailability, interruptions, or errors of the Program or its features. GIMME may from time to time request information from you to confirm your identity before renewing your Magic Pass. GIMME may delay your access to your Magic Pass until you comply with this information request. The Program and all the information accessible through it are provided for information purposes only on an "as is" and "as available" basis. We, our information providers, and their agents make no warranties, representations, or guarantees of any kind, express or implied, including but not limited to, accuracy, currency, or completeness, the operation of the Program, the information, materials, content, availability, and products. GIMME MAGIC PASS and these Magic Pass Terms are provided by GIMME and do not modify the contractual relationships among or between the individuals and entities that use GIMME's technology to offer goods or services, and GIMME or any GIMME, except as expressly set forth herein. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.
28. Unsubscribe or Stop
By signing up for our service, you consent to receiving emails and text messages from us about our activities, promotions, and updates. Additionally, if you have subscribed to our service in the past, you acknowledge and accept that you may have received promotional and marketing communications from us.
If you wish to opt out of receiving these communications in the future, you may unsubscribe at any time by following one of the methods below:
Email Unsubscribe: Send an email to hello@gimmedelivery.co.nz with the subject line "Unsubscribe" and include the following text in the body of the email: "Please remove me from your mailing and messaging lists. I no longer wish to receive promotional emails or text messages from GIMME."
Text STOP: Reply with the word "STOP" to any promotional text message you receive from us. This will automatically opt you out of future text communications.
Please note that even after opting out of promotional messages, you may still receive transactional emails and texts necessary for the fulfillment of your orders or updates to your account. If you have any questions or concerns, feel free to contact us at hello@gimmedelivery.co.nz.
29. Loyalty Points
29.1 Calculation and Value
Loyalty points are calculated at a rate of 1000 points equal to ($) NZD 1. Points are earned each time an order is placed through the GIMME Mobile Application. Additionally, GIMME reserves the right to credit or remove points at its discretion.
29.2 Expiration
All loyalty points that you currently have will expire on the 30th of June 2025. Any points earned or credited after this date will have an expiration date of 31st December 2025.
29.3 Changes to Loyalty Points Terms
GIMME reserves the right to modify the terms related to loyalty points, including but not limited to the calculation, value, earning, and expiration of points, at any time. Any such changes will be communicated through the GIMME Mobile Application or other appropriate means.
29.4 General Conditions
Loyalty points are non-transferable and cannot be exchanged for cash. GIMME's decisions regarding the allocation and use of loyalty points are final and binding. Misuse of loyalty points, including but not limited to fraudulent activity, may result in the forfeiture of points and termination of the user's account.
29.5 Usage
The points maximum usage per transaction/order will not be more than $5 or 5000 points.
30. Spin the Wheel Game
Limited Usage
You may use the "Spin the Wheel" feature no more than three times per week.
Not a Drinking Game
The "Spin the Wheel" game is designed to provide discounts and offers in accordance with the alcohol promotion and advertising rules of New Zealand. It is not intended for, nor does it promote, drinking games.
Offer Expiration
All offers or discounts won through the "Spin the Wheel" game will expire 30 days after acquisition. Unused offers will be forfeited.
Points Expiration
Any loyalty points accumulated during "Spin the Wheel" gameplay will expire at the end of the same calendar month in which they are earned.
Responsible Drinking Promotion
The "Spin the Wheel" game is not meant to promote heavy or excessive drinking. It is purely a tool to provide eligible discounts on the GIMME platform and adheres to New Zealand's responsible drinking guidelines.
Age Restrictions
The "Spin the Wheel" game is available only to users who meet New Zealand's legal drinking age requirements. Any users found violating this age requirement may have their accounts suspended and any benefits from the game revoked.
Compliance with Advertising Standards
GIMME complies with the Alcohol Advertising and Promotion Code of New Zealand. Therefore, all offers resulting from "Spin the Wheel" must meet the Code's standards, ensuring that promotions do not encourage irresponsible consumption of alcohol.
GIMME's Discretion
GIMME reserves the right to modify or discontinue the "Spin the Wheel" game at any time, as well as to void any winnings if there is evidence of misuse or fraud. All GIMME decisions regarding the game are final.
Game Availability
The Discount games may be unavailable or interrupted due to maintenance or other operational issues. GIMME is not responsible for any lost opportunities during these times.
31. Slots Machine Game (App Only)
Limited Usage
You may use the Slot Machine feature up to three times per week.
Credits
Each play costs 3 credits.
Discount-Only Purpose
The Slot Machine game is solely designed to provide special discounts and exclusive offers. It is not a drinking game and must not be used or interpreted as a tool to promote excessive or irresponsible alcohol consumption. All outcomes relate to discounts on products or services and do not encourage, reward, or require consumption of alcohol.
32. App Games
GIMME may offer optional in-app games or interactive features, including spin-based games, quizzes, or similar activities, which allow eligible users to access discounts, promotional credits, or offers on the GIMME platform.
These games are intended for entertainment and promotional purposes only. They are not drinking games and do not require, encourage, or promote the consumption of alcohol as part of gameplay or participation.
Any rewards, discounts, or promotional credits obtained through games apply only as price discounts on eligible orders and are not redeemable for cash, alcohol, or any other standalone product.
Participation in games is limited to users who meet New Zealand’s legal age requirements for alcohol purchase. GIMME reserves the right to restrict, suspend, or revoke access to games or associated rewards where misuse is suspected or where required to comply with applicable law.
Games and rewards are not intended to encourage excessive, rapid, or irresponsible consumption of alcohol.
33. Warranty Disclaimers
We do not guarantee that:
- Any content or information accessible via the Sites, including Product Price, Delivery Fee, Delivery Hours, Product description, and availability, is accurate, complete, reliable, current, or error-free. Such information is subject to change without notice.
- Your use of the Service or Sites will be uninterrupted. We do not guarantee that any information transmitted via the Service or Sites will be transmitted accurately, reliably, in a timely manner, or at all.
- The Service or Sites are free from viruses or anything else that may harm any technology.
We will endeavor to correct any errors or omissions as soon as reasonably possible after notification.
34. Limitation of Liability
To the extent legally permissible, we exclude all liability for damages, including but not limited to indirect or consequential damages arising from:
- The accuracy, completeness, fitness for purpose, or legality of any Product or information accessed via the Service or Sites.
- The transmission or reception, or failure to transmit or receive, any material.
- Your use of any information or materials on the Sites (which is entirely at your own risk).
- The supply, delivery, use, and consumption of the Products.
Our liability for loss or damage shall not exceed NZD $20.00.
Privacy Policy
Our Privacy Policy, which is incorporated into and forms part of this Agreement, may be updated from time to time. By using the Sites, you consent to GIMME collecting, storing, and using information as per the Privacy Policy.
Links to and from Other Sites
The Sites may contain links to third-party sites or resources. These links are for informational purposes only. We have no control over and do not accept responsibility for the content or products/services of these sites. Accessing third-party sites is entirely at your own risk.
Sale and Assignment
If we undergo a merger, acquisition, asset sale, or change in control, we may assign, novate, or transfer our rights and obligations under these terms without notice to you, so the Services may be provided by a different entity. In such events, we reserve the right to transfer or assign your personal information in line with our Privacy Policy.
General
Currency: All prices are in New Zealand Dollars.
GST: Prices include GST unless otherwise indicated.
No other terms: Except as expressly stated in this Agreement, all warranties, conditions, and other terms are excluded to the fullest extent permitted by law.
Entire Agreement: This Agreement and our Privacy Policy contain all terms agreed upon between us and you regarding the subject matter.
Third-party rights: All provisions of this Agreement benefit us, our subsidiaries, affiliates, third-party content providers, and licensors.
Survival: Provisions intended to survive termination shall survive. Your reuse of the Sites or Service will be governed by the then-current terms and conditions.
Severability: If any provision is unlawful or unenforceable, it shall be severed, and the remaining provisions shall continue in effect.
Location: The Service and Sites are controlled and operated by us from Christchurch, New Zealand. Sales are appropriated in New Zealand. Accessing the Sites from other jurisdictions is at your discretion and responsibility.
Governing Law: This Agreement shall be governed by New Zealand law, and both parties submit to the exclusive jurisdiction of Christchurch courts.
34. Delivery Time Estimates
Any delivery times displayed on the GIMME website, Mobile Application, or in marketing materials (including references to “45 minutes”) are estimates only and are not guaranteed delivery times.
Estimated delivery times are based on historical averages and factors such as order preparation time, distance, traffic conditions, weather, and store availability. Actual delivery times may vary.
GIMME does not guarantee delivery within any stated timeframe and will not be liable for delays, except where required by applicable law.
Delays do not entitle customers to refunds, credits, or compensation unless required under the Consumer Guarantees Act 1993 or other applicable consumer protection laws.
35. Promotional Offers
From time to time, GIMME may offer promotional credits, including sign-up credits, to eligible users. Promotional credits are provided as a discount on orders placed through the GIMME platform and are not redeemable for cash, refundable, or transferable.
Promotional credits are subject to any usage limits specified at the time of issue, including expiry dates, per-order caps, and product eligibility. The current sign-up credit expires on 31 December 2026, unless used earlier or withdrawn in accordance with these Terms.
Promotional credits may be used on orders that include alcohol only by users who are legally permitted to purchase alcohol in New Zealand and only in accordance with the Sale and Supply of Alcohol Act 2012 and applicable advertising and promotion standards.
Promotional credits are intended as a price discount and are not intended to encourage excessive or irresponsible consumption of alcohol. GIMME reserves the right to modify, suspend, or withdraw promotional credits at any time where misuse is suspected or where required to comply with applicable law.
